1. Definitions

"DataPick" refers to the DataPick Chrome extension and its related website. "Developer" refers to the individual developer operating this service. "User" refers to anyone who installs or uses DataPick.

2. Service Description

DataPick is a Chrome extension that enables users to visually select and extract structured data from web pages. It provides on-device AI-powered column labeling, template management, scheduled scraping, and export to CSV, JSON, and Google Sheets. It is offered as a Free plan and a Pro plan.

3. Pricing and Payment

Free plan: Visual picker, auto-detection, CSV/JSON export, up to 100 rows per scrape, 3 saved templates.
Pro plan: $6.99/month or one-time purchase of $19.99. Includes unlimited rows, AI column labeling, scheduled scraping, Google Sheets export, unlimited templates, and scrape history.

Payment is processed securely via Stripe through ExtensionPay. As DataPick Pro is a digital product delivered immediately upon purchase, refunds are generally not available. However, if you experience a technical issue that prevents the Pro features from functioning, please contact us and we will work to resolve the issue or provide a refund on a case-by-case basis.

4. Ethical Use and User Responsibility

DataPick is a tool for extracting publicly visible data from web pages for personal research and productivity purposes. Users are solely responsible for ensuring their use of DataPick complies with the Terms of Service of the websites they scrape, applicable data protection laws (including GDPR, CCPA, and others), and all other relevant regulations in their jurisdiction.

You agree to:

Respect the Terms of Service of websites you scrape
Not collect personal information (names, emails, phone numbers, etc.) without proper authorization
Not use DataPick to overload or disrupt servers with excessive or rapid requests
Use reasonable request intervals when scraping (DataPick defaults to 2-5 second delays)
Respect robots.txt directives where applicable
Not use extracted data for spam, harassment, or any illegal purpose

5. Prohibited Use

You agree not to:

Reverse engineer, decompile, or disassemble the extension
Use the extension for any illegal activities
Use the extension to collect personal data in violation of privacy laws
Use the extension to perform denial-of-service attacks or deliberately overload websites
Redistribute, resell, or sublicense the extension or its Pro features
Interfere with or disrupt the service or its infrastructure

6. Intellectual Property

All intellectual property rights in the DataPick extension, including its code, design, AI models, and branding, belong to the developer. Users are granted a limited, non-exclusive license to use the extension in accordance with these terms.

Data extracted by users using DataPick remains the property of its respective owners. DataPick does not claim any rights over user-extracted data.

7. Limitation of Liability

DataPick is provided "as is" without warranties of any kind, either express or implied. The developer shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the extension, including but not limited to:

Loss of data or accuracy of extracted data
Consequences of scraping websites in violation of their Terms of Service
Legal claims arising from the user's scraping activities
Website changes that break saved templates or scrape configurations
Interruption or discontinuation of the service

8. Subscription Terms

Monthly Pro subscriptions are billed automatically via ExtensionPay/Stripe. You may cancel your subscription at any time. Upon cancellation, Pro features remain active until the end of the current billing period. One-time purchase licenses are perpetual and do not expire.

9. Changes to These Terms

We reserve the right to modify these terms at any time. Continued use of the extension after changes constitutes acceptance of the updated terms. Significant changes will be communicated via extension updates.

10. Governing Law

These terms shall be governed by and construed in accordance with the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the courts located in the developer's place of residence.
